CEOs and CTOs should begin with a precise account of what changed. An immigration processing interruption can affect employee confidence, long-term staffing and delivery commitments. The response should connect legal advice with workforce planning and engineering decisions.
What has been announced
On 8 October 2026, US officials announced a suspension of new and pending permanent labour certification applications involving Microsoft, Adobe, Cognizant, Infosys, Tata Consultancy Services, Wipro, HCL Technologies and Capgemini. The administration alleged programme abuse. Allegations must be distinguished from established findings. Reuters reporting
The announced action concerns PERM. The Department of Labor generally certifies the labour market requirements before an employer seeks the relevant immigration authorisation from USCIS. Certification is one stage in a process, rather than a green card in itself. Department of Labor explanation
The reported scope does not establish a blanket foreign-hiring or H-1B ban. No fixed end date was announced. Detailed implementation questions, including the legal entities and case-stage exceptions covered, need authoritative clarification. Reuters on scope and ABC News on duration
Read the numbers before drawing conclusions
Microsoft says 80% of approximately 6,000 H-1B applications in its last fiscal year concerned extensions or status changes for existing employees. It also says employees doing comparable work receive equal pay. These are company statements, not an independent audit. Microsoft response
Executives should apply the same discipline to their own data. Petition totals, new hires and people arriving from overseas are different measures. Comparing a filing count with a redundancy count does not establish that one employee replaced another. That conclusion requires matched evidence about roles, locations, dates and individuals.
Keep the employee in view
For someone awaiting permanent residence, uncertainty may affect decisions about a home, a family or a career. Employers should give affected people access to qualified immigration counsel and clear, private updates. Managers should not promise an outcome or infer anyone’s status from their name, nationality or appearance.
Current permission to work and progress towards permanent residence need separate, case-specific review. A general announcement cannot answer every employee’s question about their own circumstances.
What CEOs should do
Assign one accountable executive to coordinate HR, immigration counsel, finance and technology leadership. Ask for a restricted-access view of affected cases, legal deadlines and business dependencies. Report operational exposure to the board without distributing unnecessary personal information.
Require a review of recruitment records, role requirements, remuneration and relevant restructuring decisions. Preserve the evidence. Where a process is weak, agree corrective action with counsel. Do not change records retrospectively to create a convenient explanation.
Fund employee support and test delivery commitments against realistic staffing scenarios. For suppliers, request evidence of service continuity and relevant contractual obligations. A supplier’s name on the announced list does not, by itself, prove that a particular project will fail.
The CTO checklist
Map critical services to the people who can operate, maintain and recover them. Identify single-person dependencies. Use documented procedures, paired ownership and practical cross-training to reduce avoidable disruption across the whole team.
Build staffing scenarios around verified constraints. Distinguish an immediate capacity issue from a possible future retention risk. Give each scenario a decision trigger, a responsible owner and a cost. Revisit commitments when the evidence changes.
Review proposed location changes with legal, security and commercial teams. Moving work can introduce data access, customer consent, tax or employment questions. Changing a delivery location should be a deliberate business decision, not an automatic response to a headline.
Three comparisons that improve decisions
Application volume measures administrative activity. Workforce capacity depends on people, skills and availability. Keep both measures, with clear definitions.
Recruitment planning asks how future roles will be filled. Continuity planning asks how existing services will keep running. Each needs its own owner and evidence.
A low quoted staffing rate describes part of the cost. A delivery assessment also examines transition effort, quality, compliance and the consequences of delay. Compare the full commitment before choosing a response.
Keep AI investment tied to evidence
This event does not establish that automation can replace affected roles. Where AI tools are considered, define the task, test quality and security, measure the work saved and retain clear human accountability. Do not use an immigration interruption as a substitute for a business case.
The immediate leadership responsibility is to protect people, establish the facts and maintain dependable services. Workforce policy, compliance records and technical architecture should support that responsibility together.
If a key immigration process paused in your organisation, would your leadership team know which decisions to make, which evidence to trust and which employees need support?
Think mathematically. Engineer intelligently. Lead strategically. Build responsibly. Scale globally. Create real business value through artificial intelligence.
